What is Post-Conviction Relief?

Post-conviction relief is a critical legal mechanism that serves as a last resort for individuals who have been convicted of a crime and have exhausted all their available appeals.  It provides a glimmer of hope for those who believe that justice has not been fully served in their case.  Only certain circumstances warrant post-conviction relief, including ineffective assistance of counsel, prosecutorial misconduct, or the discovery of new evidence.

Once a defendant decides to pursue post-conviction relief, a variety of motions can be filed depending on the specific circumstances of the case.  In North Carolina, these motions are commonly referred to as "Motions for Appropriate Relief" or "MARs." These motions are designed to bring attention to the issues that warrant reconsideration of the conviction and request appropriate relief based on the findings.

If a defendant’s MAR is successful, the relief can be significant such as a new trial or a new sentencing hearing.  In extraordinary cases, a successful MAR can result in the dismissal of the charges entirely.
