Right of Way Taking

A right of way taking is the most extreme form of eminent domain taking.  When the Department of Transportation takes new right of way, they acquire title and ownership of the new property.  The land and any improvements that were located on the land become the property of the Department of Transportation.  When new right of way is acquired for road construction the taking authority (normally the Department of Transportation) is required to pay the “former” property owner a legal term known as “just compensation” for their property that was taken or damaged.  When your land is taken you only have one chance to be paid and an experience eminent domain attorney can help you access your claim.  If your business, home, farm, or undeveloped property will be impacted by an eminent domain taking please contact The Law Group to discuss your rights (910-251-6088).  Check out our Facebook page as well: https://www.facebook.com/GottLaw/?eid=ARCdIX8Th6a49kNkRSfOG2oauUPheOkZTc-aapwvwu2qMXgIADhgaZvATQIm6cDHGrth_HfTKY3l6kSi
